Enterprise Community Partners, Inc. ("Enterprise") is a Maryland 501(c)(3) nonprofit corporation whose mission is to see that all people in the United Sates have the opportunity for fit and affordable housing and to move up and out of poverty. enterprisecommunity.org is Enterprise's website (the "Site"). You (a " Visitor") agree that your use of the Site will be governed by the following Conditions of Use Agreement (the "Agreement"). The purpose of this Site is to provide Visitors with information on the work of the Foundation and the community development field. All documents on the Enterprise Resource Database TM ( the"ERD") and MoneyNet TM are copyrighted by Enterprise or a Third Party Content Provider. Visitor is permitted to reprint documents in the ERD and MoneyNet so long as the reprints are not used commercially and as long as they include copyright information and list ERD or MoneyNet as their source.
All documents copyrighted by Enterprise may be used or modified by an individual or a nonprofit organization Visitor for non-commercial use, as long as the adapted work clearly states it is adapted from a work copyrighted by The Enterprise Community, Inc. Documents copyrighted by Third Party Content Providers may not be modified or adapted unless the Third Party Provider has given specific permission along with the copyright information on the document itself or unless the Visitor obtains specific permission from the Third Party copyright holder. Visitor Posting Information and Linking to Enterprisecommunity.org
In the Promote Your Website section, Visitor may create a link to the Visitor's website and comment on linked third party websites. In the Community Development Job Board section, Visitors may post information about job openings. Both Resources are made available for the Visitor's use so long as the content in Visitor's website or posting (1) is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and (2) does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."
As a condition to linking to Enterprise's website or posting information on the Community Development Job Board section, Visitor promises not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of a comment or other content. Enterprise reserves the right, but not the obligation, to remove or edit content not in compliance with this Agreement.
Visitor represents and warrants that Visitor owns or otherwise controls all of the rights to the content that Visitor posts; that the content is accurate; that use of the content supplied does not violate this Agreement and will not cause injury to any person or entity; and that the Visitor will indemnify Enterprise, its employees, officers, trustees, agents, subsidiaries and affiliates for all claims resulting from content that the Visitor supplies.
If a Visitor posts content or submits material, and unless Enterprise indicates otherwise, the Visitor grants Enterprise and its subsidiaries and affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. The Visitor also grants Enterprise and its affiliates and licensees the right to use the name that is submitted by Visitor in connection with such content.
Enterprise has the right but not the obligation to monitor and edit or remove any activity or Content. Enterprise takes no responsibility and assumes no liability for any content posted by the Visitor or any third party.
Choice of Law; Forum Selection
All applicable policies governing this website are construed and enforced in accordance with and shall be governed by, the laws of the State of Maryland, exclusive of its conflicts of law rules and federal law. Visitor agrees that any suit, action or proceeding instituted with respect to any actions resulting from the use of this Site shall be brought in any state or federal court located in the State of Maryland and Visitor consents to the personal jurisdiction of such courts. Visitor irrevocably waives any objection to, and any right of immunity from, the jurisdiction of such courts or the execution of judgments resulting therefrom, on the grounds of venue or the convenience of the forum.
Severability
If any term in this Agreement is held to be inconsistent with any present or future law, ruling, rule or regulation of any court or authority having jurisdiction over the subject matter of this Agreement, such provision will be deemed to be rescinded or modified to the minimum extent necessary to comply with such law, ruling, rule or regulation, and the remainder of this Agreement will not be affected thereby.
Modification
Enterprise reserves the right to modify the terms of this Agreement at any time in its discretion. The terms of the Agreement in effect at the time of Visitor's use will be the operative terms governing Visitor's use of this Site. |
